A further S.172 request will be sent to the nominated driver asking them to confirm that they were the driver at the time of the alleged offence.

To accept the offer of a fixed penalty you will need to make payment and submit your licence to HMCTS. You can make payment either online at https://penaltynotice.homeoffice.gov.uk or by ringing the 24 hour payment line on 0300 1231 481. Please note that you will need your 16 digit reference number, your offence code, your offence date and your penalty amount. Once you have made payment, as described above, you must then send your driving licence details, along with the completed 'Conditional Offer of Fixed Penalty' form, to:

You will need to return the Conditional Offer of Fixed Penalty form to the Safer Roads Unit, Po Box 2122, Liverpool, L3 3YW, with an attached letter explaining that you wish to have the matter dealt with by the Magistrates' Court. A file will be prepared and a Single Justice Procedure Notice will be sent to you in due course. We recommend that you seek legal advice before choosing this option.
If you are found guilty of the offence, the Magistrates have the discretion when imposing a fine, penalty points and prosecution costs and will also make provision for a victim surcharge.
You will have received a Single Justice Procedure Notice because the matter is being dealt with by the Magistrates' Court. This will either be because you have failed to respond to the S.172 request for driver information or the Conditional Offer of Fixed Penalty, because the seriousness of the offence meant that you could not be offered a fixed penalty or course offer or because you have elected to have the matter dealt with by the courts.
